Terms and Conditions
1. Scope of These Terms and Conditions
A purchase contract is concluded with JE DESIGN GmbH, Benzstrasse 18-20, 74211 Leingarten, Germany.
All deliveries and services provided to the customer are exclusively subject to the following Terms and Conditions. Any terms and conditions of the contractual partner that deviate from or conflict with these Terms and Conditions shall not be recognized.
2. Conclusion of Contract
The product illustrations contained in our advertising material and online shop do not constitute legally binding offers. By placing an order, the customer submits a binding offer to purchase the goods ordered.
The purchase contract is only concluded upon dispatch of our order confirmation to the customer. In the case of orders placed electronically, the contract text will be stored electronically by us and receipt of the order will be confirmed without undue delay by electronic means.
The order confirmation e-mail includes these Terms and Conditions and the statutory information regarding distance selling contracts. Neither the confirmation of receipt nor the acceptance of a telephone order constitutes binding acceptance of the customer's offer.
We are entitled to accept the customer's binding offer within seven working days from receipt of the order. In the case of orders placed electronically, acceptance may be declared within three working days from receipt of the order.
3. Right of Withdrawal
Consumers have a statutory right of withdrawal. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.
In the event of withdrawal, the customer shall bear the direct costs of returning the goods. The return shipping costs are estimated at a maximum of approximately EUR 100.
4. Delivery
Deliveries within Germany are made exclusively against cash on delivery or advance payment. Deliveries to foreign countries are made exclusively against advance payment.
5. Prices
All prices are final prices and include the applicable statutory value-added tax (VAT), excluding shipping and delivery costs.
Payments shall be made exclusively to us. Representatives are not authorized to accept payments on our behalf.
In the event of withdrawal, the customer shall bear the costs of returning the goods.
6. Warranty
Unless longer warranty periods have been agreed for individual products, the statutory warranty period is two years from delivery of the goods for new products and one year from delivery for used products.
This limitation of the warranty period for used goods shall not apply to claims for damages arising from injury to life, body, or health, claims based on guarantees, or claims arising under product liability legislation.
The limitation shall also not apply to breaches of essential contractual obligations caused by slight negligence where such obligations are necessary for the proper performance of the contract. In cases of slightly negligent breach of essential contractual obligations, our liability shall be limited to damages typically foreseeable at the time of conclusion of the contract or at the latest at the time of the breach.
7. Liability
The purchaser is responsible for ensuring that all modifications and conversions carried out on a vehicle intended for use on public roads are properly registered in the vehicle documents where required.
The purchaser shall, where necessary, present the vehicle to the relevant technical inspection authority. Responsibility for the approval and registration of modified vehicles or vehicle components rests solely with the purchaser.
We exclude liability for slightly negligent breaches of duty by ourselves or our vicarious agents. This exclusion of liability shall not apply to claims arising from injury to life, body, or health, claims based on guarantees, or claims arising under product liability legislation.
The exclusion of liability shall likewise not apply to slightly negligent breaches of essential contractual obligations where such obligations are necessary for the proper performance of the contract. In such cases, our liability shall be limited to damages typically foreseeable at the time of conclusion of the contract or at the latest at the time of the breach.
8. Miscellaneous
The laws of the Federal Republic of Germany shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG) of 11 April 1980.
If the contractual partner is a merchant, legal entity under public law, or special fund under public law, the exclusive place of jurisdiction for all disputes arising out of or in connection with the contractual relationship shall be Heilbronn, Germany.
